Host Terms and Conditions
These Host Terms and Conditions (“Host Terms”) set out the terms and conditions between Palatelocal Technologies Private Limited, operating under the brand name Palatelocal (“Palatelocal”, “we”, “us”, or “our”), and you, the individual offering a dining experience (“Host”, “you”, or “your”) through the Palatelocal platform available at www.palatelocal.com and the Palatelocal mobile application (the “Platform”).
By registering your dining experience (“Experience”) on the Platform, you acknowledge and agree to be bound by these Host Terms and the Privacy Policy. Please read these Host Terms carefully before registering or listing your Experience. By proceeding, you are deemed to have read, understood, and accepted these Host Terms.
Registration and Onboarding
To be eligible to register and use the Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
You may be required to verify your identity, age, or other credentials. The collection and use of personal information is governed by our Privacy Policy.
You agree to:
- Provide accurate, current, and complete information during registration
- Keep your account details updated
- Safeguard your login credentials
- Notify us immediately of any unauthorized account use
Listing an Experience
To list your Experience, you must submit accurate and complete information, including:
- Host name, full address, and contact details
- Detailed description of the Experience (capacity, meal type, cuisine, menu, inclusions, availability)
- Pricing details including applicable taxes and charges
- Full ingredient disclosure and allergen information
- High-quality and genuine images of the food and dining environment
- Bank account details for settlements
- House rules and guest requirements (including pet policies)
You represent that you possess all necessary licenses, permits, and approvals required under applicable law.
Palatelocal reserves the right to remove or delist any Experience at any time if information provided is incomplete, inaccurate, misleading, unlawful, or poses safety or medical risks.
Bookings and Notifications
- Hosts will receive booking notifications via the Platform or registered contact details
- A confirmed booking constitutes a legally binding agreement between the Host and the Guest
Payments
Payments will be remitted to your designated bank account after successful completion of the Experience, minus applicable commissions, fees, and taxes.
Payouts will be released upon:
- Completion Confirmation by both Host and Guest
- Lapse of Dispute Window (no dispute raised within 24 hours)
Palatelocal may withhold or adjust payouts in cases of disputes, cancellations, or policy violations.
Hosts are responsible for:
- Maintaining accurate banking details
- Payment of all applicable taxes on earnings
Cancellation and Refunds
All cancellations and refunds are governed strictly by the Cancellation and Refund Policy, which forms an integral part of these Host Terms.
Right to Deny Entry or Remove a Guest
Hosts may deny entry or remove a Guest for reasonable grounds, including:
- Misconduct or unruly behavior
- Violation of house rules
- Violation of applicable laws or these Host Terms
Palatelocal is not responsible for handling such situations. Hosts remain solely responsible for managing incidents and may report them to Palatelocal.
Guests may leave public reviews. Hosts may report reviews believed to be inaccurate or unlawful for review by Palatelocal.
Host Standards, Safety, and Hygiene
Hosts must comply with all applicable laws and food safety regulations.
Hosts are solely responsible for:
- Food quality, safety, and hygiene
- Cleanliness and maintenance of the residence and dining area
Palatelocal does not conduct inspections and expressly disclaims liability related to food quality, safety, or Guest health issues.
Hosts must behave in a courteous, respectful, and non-discriminatory manner at all times.
Promotions and Discounts
- Promotions on the Platform require prior written approval
- Palatelocal does not guarantee booking volumes or success
- External promotions run independently are outside Palatelocal’s responsibility
Liability and Indemnification
Palatelocal acts only as an intermediary platform.
Hosts agree to indemnify and hold harmless Palatelocal from all claims arising from:
- Breach of these Host Terms
- Negligence, misconduct, or legal violations
- Injury, illness, or damage suffered by Guests or third parties
Palatelocal’s total liability shall not exceed INR 1,000.
Disclaimers
The Platform is provided on an “as is” and “as available” basis without warranties of any kind.
Palatelocal does not:
- Verify food safety, legality, or Experience quality
- Guarantee bookings or platform availability
- Conduct background checks on Guests
Hosts must not solicit off-platform bookings. Violations may result in delisting or withholding of payments.
Intellectual Property Rights
All Platform content is owned or licensed by Palatelocal.
Hosts grant Palatelocal a non-exclusive, worldwide, royalty-free license to use Host-provided content for marketing and promotional purposes.
Data Protection and Confidentiality
Hosts must:
- Use Guest data solely for providing the Experience
- Comply with applicable data protection laws
- Maintain confidentiality of Palatelocal’s proprietary information
Amendment
Palatelocal may amend these Host Terms at any time. Continued use of the Platform constitutes acceptance of updated terms.
Force Majeure
Palatelocal shall not be liable for failures caused by events beyond reasonable control, including natural disasters, pandemics, or technical failures.
Termination
Palatelocal may suspend or terminate access if:
- Host violates these Terms or applicable law
- Repeated cancellations occur
- Safety or hygiene complaints arise
- Misconduct is reported
Upon termination, Hosts may not provide any Experiences.
Governing Law and Dispute Resolution
These Host Terms are governed by the laws of India. Courts in Bengaluru, India shall have exclusive jurisdiction.
Miscellaneous
These Host Terms, along with the Cancellation and Refund Policy and Privacy Policy, constitute the entire agreement between Palatelocal and the Host.
